Welcome to US Skip Tracing. These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://usskiptracing.com/ (the “Site”) and our AI-powered skip tracing, deep skip tracing, and list-and-skip-tracing lead generation services (collectively, the “Services”).

By accessing the Site, registering an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

“Client,” “you,” and “your” refer to the person or entity using the Services. “The Company,” “we,” “us,” and “our” refer to US Skip Tracing. “Traced Individual” refers to any third party whose information is returned to you as part of a skip tracing result.

1. The Services

We provide pay-per-record skip tracing and data lookup services, including AI Instant Skip Tracing, Deep Skip Tracing, and List + Skip Tracing (Lead Generation), billed per record with no subscription or minimum order requirement. Order details, pricing, and delivery timelines are as described on the Site at the time of your order.

Credit Replacement Guarantee. If a record you purchase returns no usable data, we will replace that credit as described on the Site. This guarantee does not entitle you to a cash refund unless otherwise stated, and does not extend to records that return data you consider inaccurate, outdated, or otherwise unsatisfactory for reasons other than a missing result — see Section 4 (Data Accuracy Disclaimer).

2. Accounts and Payment

You must provide accurate registration information and are responsible for maintaining the confidentiality of your account credentials. Payments are processed through Stripe; we do not store your full payment card details. All fees are due at the time of order unless otherwise agreed in writing. We reserve the right to refuse, cancel, or limit any order at our discretion, including where we suspect fraud, abuse, or a violation of these Terms.

3. Permissible Use and Prohibited Conduct

This section is the core of our agreement with you, and violating it may result in immediate account suspension without refund.

Our Services are intended solely for lawful business purposes, such as identifying and reconnecting with property owners, sellers, or other parties in connection with real estate transactions. By using the Services, you certify and agree that you will not:

  • Use any data obtained through the Services to stalk, harass, threaten, intimidate, or invade the privacy of any individual;
  • Use the data to make any decision regarding a Traced Individual’s eligibility for employment, credit, insurance, or housing/tenancy — a use governed by the Fair Credit Reporting Act (FCRA). Our Services are not FCRA “consumer reports,” and we are not a consumer reporting agency. You represent that you will not use our data for any FCRA-regulated purpose;
  • Use the data in a manner that violates the Driver’s Privacy Protection Act (DPPA), the Telephone Consumer Protection Act (TCPA), applicable Do-Not-Call regulations, or any other federal, state, or local law;
  • Resell, republish, or redistribute any data obtained through the Services in bulk or as a standalone product, outside of your ordinary business use;
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Site outside the ordering process we provide.

You are solely responsible for ensuring your use of any phone number, email address, or other contact information obtained through the Services complies with applicable law, including TCPA consent requirements for calls and texts.

We reserve the right, at our sole discretion, to suspend or terminate your account, without refund, if we reasonably believe you have violated this section, and to report unlawful conduct to appropriate authorities.

4. Data Accuracy Disclaimer

Skip tracing results are compiled from public records and licensed third-party data sources. We do not independently verify, and do not guarantee, the accuracy, completeness, currency, or deliverability of any record provided through the Services, including whether a phone number is active, correctly associated with the intended individual, or registered on a Do-Not-Call list. Results are provided “as-is” and “as available.” You are responsible for verifying information before relying on it for any purpose, and for your own compliance obligations when contacting any individual using data we provide.

5. Intellectual Property

Unless otherwise stated, US Skip Tracing and/or its licensors own the intellectual property rights in the Site and its content. You may access the Site for your own business use, subject to these Terms. You must not republish, sell, sublicense, reproduce, or redistribute material from the Site, other than data you have properly purchased through the ordering process for your own business use.

6. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and Services are provided “as-is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or damages arising from your use of any data provided through the Services (including any claim, fine, or penalty arising from your communications with a Traced Individual).
  • This limitation applies regardless of the legal theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless US Skip Tracing, its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services in violation of Section 3 (Permissible Use and Prohibited Conduct); (b) your violation of any applicable law in connection with data obtained through the Services, including the TCPA, FCRA, or DPPA; or (c) any claim brought by a Traced Individual or third party arising from your use of data we provided to you.

9. Cookies

We use cookies, including for advertising measurement (such as the Meta Pixel) and site functionality. By using the Site, you agree to our use of cookies in accordance with our Privacy Policy.

10. Third-Party Links

The Site may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. Organizations wishing to link to the Site should contact us at contact@usskiptracing.com; we reserve the right to request removal of any link to the Site at any time.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for violation of these Terms, suspected fraud or misuse, non-payment, or at our discretion. You may close your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (including Sections 3, 4, 7, and 8) will survive.

12. Governing Law and Disputes

These Terms are governed by the laws, without regard to conflict of law principles. Any dispute arising out of these Terms or the Services shall be resolved in the state or federal courts, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may amend these Terms at any time. Material changes will be reflected by an updated “Last Updated” date. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
